The Ontario severance guide. Eligibility and payment.
Ontario ESA termination pay and statutory severance depend on service, wages and eligibility. They are separate entitlements. This guide explains the limits of the estimate and when payment is due. Then run the numbers in the Severance calculator.
Individual termination pay can reach eight weeks under Ontario’s ESA. Eligible statutory severance can reach 26 weeks and has a separate service and employer test. The calculator excludes group terminations, working notice, ESA exemptions and any additional contract or common-law entitlement. See Ontario’s termination and severance guidance.
The normal ESA payment deadline is the later of seven days after employment ends and the next regular payday. Statutory severance can be paid in instalments only with the employee’s written agreement or the Director’s approval, over no more than three years. An instalment default makes the balance due immediately.
